BoardHydra

Terms of Service

1. Agreement

These Terms of Service (“Terms”) are an agreement between you and Christopher Hunsinger, doing business as BoardHydra (“BoardHydra”, “we”, “us”). They cover the BoardHydra website, web app, emails and API (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

If you use BoardHydra for an organization, you agree to these Terms for that organization and confirm that you're allowed to. “You” then means both you and the organization.

2. Who can use BoardHydra

You must be at least 13 years old, or at least 16 in the European Economic Area and the UK, and able to form a binding contract. If you're under the age of majority where you live, a parent or guardian must agree to these Terms for you. You can't use BoardHydra if you're barred from doing so by law, or if we previously closed your account for breaking these Terms.

3. Your account

  • Give accurate information and keep your email address up to date: we use it for sign-in, security and billing notices.
  • Keep your password and API keys secret. You're responsible for activity on your account. Tell us right away at [email protected] if you think someone else has access.
  • An account is for one person. Don't share sign-ins; invite teammates instead.

4. Plans, billing and cancellation

Plans

BoardHydra has a Free plan and paid plans (currently Pro and Business). Each plan's features, limits and price are shown on our pricing section and in the app when you subscribe. A team's Pro features and seat limits follow the plan of the team's owner.

Who you're buying from

Paid plans, API credits and token packs are sold through Link (“Sold through Link, LLC”), Stripe's checkout, which acts as the merchant of record. Link processes your payment, calculates and collects any sales tax, VAT or GST, sends receipts and invoices, and provides payment and billing support. Link's and Stripe's terms also apply to your purchase. The charge on your statement appears as “LINK.COM* BOARDHYDRA”. We provide the Service you buy.

Subscriptions and automatic renewal

Paid plans are billed monthly in advance and renew automatically each month at the then-current price, plus applicable taxes, until you cancel. By subscribing, you authorize recurring charges to your payment method.

Cancelling

Cancel any time in the app under Plan & billing → Manage billing, or through Link. Cancellation takes effect at the end of your current billing period. You keep your paid features until then, and you won't be charged again. Your account then moves to the Free plan; your boards stay, but Pro-only views and higher limits stop.

Changing plans

When you upgrade or downgrade, we prorate the price difference for the rest of the billing period, as shown when you make the change.

Refunds

Except where the law requires otherwise, payments are non-refundable, and we don't give refunds or credits for partial months or unused features. If you were charged by mistake or something went wrong, contact [email protected] within 60 days of the charge and we'll make it right. Refunds are issued to your original payment method through Link. This doesn't affect any rights you have under consumer protection law.

Failed payments

If a payment fails, we and Link will let you know and retry the charge for a period. If it still can't be collected, your subscription may be cancelled and your account moved to the Free plan.

Price changes

We may change plan prices. We'll tell you at least 30 days before a new price applies to your subscription, and you can cancel before then.

Free trial from the survey

We may offer a free period of Pro features, for example for answering our survey. It's available once per person, can't be exchanged for money, and doesn't change API limits.

5. API credits

API credits are a one-time purchase, or a trade for tokens in the Shop, that pays for API requests beyond your plan's allowance, or for write requests on the Free plan. Credits don't expire while your account is open. They aren't refundable, except as described in section 4 or where required by law. They have no cash value, can't be transferred, and are lost if your account is deleted.

6. Tokens and the Shop

  • You earn tokens by using BoardHydra, and you can buy token packs in the Store (Hydra Shop → Store). You spend tokens in the Shop on cosmetic items, such as colors, backgrounds, frames, name styles and completion effects, and on API credits.
  • Tokens have no monetary value, even when you bought them. They're a limited license to use in BoardHydra, not your property or a currency. They can't be sold, transferred, traded, cashed out, or exchanged for money or anything outside BoardHydra.
  • Token packs: the tokens are added to your account as soon as payment goes through. Purchases are final once you've spent any of the tokens. If something went wrong with a purchase, contact [email protected] within 60 days and we'll make it right, as described in section 4.
  • Shop items are a limited license to use that cosmetic in BoardHydra. We may change, rebalance or retire items, prices and how tokens are earned. If we retire an item you own, you keep using it where we reasonably can.
  • We may remove tokens or items earned by mistake, through bugs, or by breaking these Terms, for example by using multiple accounts to farm rewards or referrals. If a payment is reversed or charged back, we may remove the tokens it bought.
  • Tokens and items end when your account is deleted. Deleting your account doesn't refund unspent tokens.

7. Your content

You own your content: the boards, cards, text, photos and files you put into BoardHydra. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display and transmit your content only as needed to run, secure and improve the Service. That includes showing it to the people you share it with and creating thumbnails of photos. This license ends when your content is deleted, except for copies in backups for a limited time and content others are entitled to keep, such as content on a team's boards.

You're responsible for your content. You confirm you have the rights to it and that it doesn't break the law or these Terms. We don't use your content to train AI models or for advertising.

If you send us feedback or ideas, we may use them without owing you anything.

8. Boards, teams and sharing

  • When you share a board or invite people to a team, they can see and, depending on their rank or role, change its content.
  • Teams own their boards. The team owner and the ranks they set decide who can do what on team boards, even on boards you created. If you leave or are removed from a team, you lose its boards.
  • Team owners are responsible for their team's members, invitations and seat limits.
  • A board's owner can make it public, so anyone with its link can view it read-only. The owner is responsible for what a public board shows, including content other members added. We may make a public board private if it breaks these Terms.
  • To provide support or enforce these Terms, our administrator may open a board with visible “support access”, as described in our Privacy Policy.

9. Acceptable use

Don't use BoardHydra to:

  • break the law, or help others do so;
  • upload content that is illegal, infringes others' rights, sexually exploits minors, harasses or threatens people, or promotes violence;
  • use a profile photo that is sexual, violent, hateful or misleading, or that shows someone else without their permission;
  • send spam or unwanted invitations, or impersonate anyone;
  • upload malware, or try to access accounts, boards or systems you're not authorized to use;
  • abuse rewards or limits, for example by creating multiple accounts to farm tokens, referrals or free trials, or by evading rate limits, quotas or plan restrictions;
  • scrape the Service other than through the API, overload it, or test its load or security without our written permission;
  • reverse engineer the Service, except where the law allows it; or
  • resell or rent access to the Service without our permission.

Reporting: use “Report photo” on a profile photo or a board photo, or email [email protected]. Reports are reviewed by our moderators; the person reported isn't told who reported them. We may remove reported content and suspend accounts that break these rules. Please don't file false reports.

If you find a security issue, please report it to [email protected] and give us reasonable time to fix it. Report other abuse to [email protected].

10. The BoardHydra API

You can use the API with keys from your account, within your plan's rate limits and quotas and the API credits you hold. Keep keys secret: requests made with your keys count against your account. We may change, limit or version the API. For changes that break existing integrations, we'll try to give reasonable notice.

11. Third-party services

BoardHydra uses third-party services, such as map images from Esri and address search from HERE. These are provided as-is, may not always be accurate or available, and come with their own terms. We aren't responsible for third-party websites or services you choose to use.

12. Suspension and termination

You can stop using BoardHydra and delete your account at any time from your Account page. Cancel any paid subscription first.

We may suspend or close your account, or remove content, if you break these Terms, don't pay, create risk or legal exposure for us or others, or if the law requires it. Where reasonable, we'll tell you first and give you a chance to fix the problem. If we discontinue the Service entirely, we'll give you at least 30 days' notice so you can get your content out, and refund any prepaid fees for the period after it ends.

Sections that by their nature should survive termination will survive, including sections 6, 7 and 14–18.

13. Changes

We're constantly improving BoardHydra and may add, change or remove features. We may update these Terms. For important changes, we'll tell you by email or in the app at least 14 days before they take effect, unless the change is required by law or to address security. If you keep using BoardHydra after changes take effect, you accept them. If you don't agree, stop using the Service and cancel any subscription.

14. Disclaimers

We work hard to keep BoardHydra reliable and your data safe, but the Service is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free or free of data loss. Keep your own copies of anything critical.

15. Limitation of liability

To the fullest extent the law allows, BoardHydra won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Service or these Terms. Our total liability for any claim relating to the Service or these Terms is limited to the greater of (a) the amount you paid for the Service in the 12 months before the event that gave rise to the claim, and (b) US $50.

Some places don't allow these limits, so they apply to you only as far as the law permits. Nothing in these Terms limits liability that can't be limited by law.

16. Indemnity

If someone brings a claim against us because of your content, your use of the Service in breach of these Terms, or your violation of the law or someone else's rights, you'll defend and compensate us for the resulting losses and reasonable legal costs, to the extent the law allows.

17. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania and applicable US federal law, without regard to conflict-of-law rules. Before filing a claim, please contact us at [email protected] and give us 30 days to try to resolve it informally. Any claim that can't be resolved this way will be brought in the state or federal courts located in Pennsylvania, and both parties consent to their jurisdiction. If you're a consumer in the EEA, UK or elsewhere with mandatory local protections, you keep those protections and may also bring claims in your local courts.

18. General

  • These Terms and our Privacy Policy are the whole agreement between you and us about the Service.
  • If any part of these Terms is unenforceable, the rest stays in effect.
  • If we don't enforce a right, we haven't waived it.
  • You can't transfer these Terms without our consent. We may transfer them, for example as part of a sale or reorganization of the BoardHydra business, and will tell you if we do.
  • We aren't liable for delays or failures caused by events beyond our reasonable control.
  • We may send notices to your account email or show them in the app. You can reach us at the addresses below.
